Will Execution & Registration

A Good Draft Still Needs Correct Execution

This page should give the user a clear answer, practical next steps and a responsible explanation of where guided preparation ends and professional advice may be appropriate.

01

Signing and attestation

For an ordinary Will, the testator must sign or mark the document, or it may be signed by another person in the testator's presence and by direction. It must be attested by two or more witnesses in the manner required by Section 63 of the Indian Succession Act, 1925.

02

Choose witnesses carefully

Witnesses should be competent and independent. Beneficiaries and their spouses should generally not be used as attesting witnesses because the law can affect benefits given to an attesting witness or spouse.

03

Registration is generally optional

Section 18 of the Registration Act, 1908 places Wills among documents whose registration is optional. Registration can create an official record but does not cure defects in capacity, voluntariness or execution.

04

State and local procedure

Registration office processes, appointment systems and document requirements can vary administratively. Users should follow the current procedure of the relevant registration authority.
